Ann Arbor, MI — The Michigan Court of Appeals has upheld Ann Arbor Public Schools’ authority to ban guns on school property and at school-sponsored activities. The Court rejected the argument that state law “preempted” the powers of public schools to regulate this activity. Instead, the Court ruled that state law, which itself imposes a blanket prohibition on concealed carry on school grounds with certain exceptions, permits schools themselves to promulgate policies consistent with this ban.
The Campaign to Keep Guns Off Campus, which has advocated against firearms in Michigan’s K-12 schools and college campuses, applauded this decision. Andy Pelosi, Executive Director of The Campaign, stated: “Throughout the country, state legislatures have become more and more emboldened to attempt to introduce firearms into elementary and secondary schools. This has especially been the case since President-elect Donald Trump made a campaign promise to eliminate federal gun-free school zones.
But there is a reason that Americans have traditionally recognized the need for schools to be gun-free. And supporters of this kind of policy have given no compelling reason why this tradition must now change. To the extent we continue to believe that authority over schools should remain at the local level, we should stand by policies like that of Ann Arbor Public Schools.”
